Court Dismisses Ken Ofori-Atta's Application to Strike Out Arrest Warrant

An Accra court has dismissed an application filed by former Finance Minister, Ken Ofori-Atta, to strike out a warrant issued for his arrest by the Office of the Special Prosecutor (OSP).

The court ruled on Thursday, July 31, 2025, that the application lacked merit and dismissed it in its entirety.

In March this year, Ofori-Atta filed a lawsuit against the Office of the Special Prosecutor, requesting compensation for being declared wanted.

He argued, during the hearing of the case, that the OSP unlawfully obtained the warrant and asked the court to set aside all related proceedings, including an Interpol Red Notice alert.

However, the court's ruling on Thursday upheld the validity of the arrest warrant and related proceedings.

The dismissal of Mr Ofori-Atta's application means that the arrest warrant and the Interpol Red Notice remain in effect.

Consequently, the OSP can now continue to pursue its investigation and take further action as necessary.

Ken Ofori-Atta declared wanted

Ken Ofori-Atta was declared wanted by both the Economic and Organised Crime Office (EOCO) and the National Intelligence Bureau (NIB).

According to a Joy News report, the two agencies have initiated separate investigations into Ofori-Atta’s financial activities during his time as Ghana’s Minister of Finance.

The former minister is already under intense investigation by the Office of the Special Prosecutor, which declared him wanted on June 2 and issued a Red Notice.

Ofori-Atta is facing five investigations under the special prosecutor, including the contractual agreements between Strategic Mobilisation Ghana Limited and the Ghana Revenue Authority, as well as procurement and financial transactions related to the National Cathedral.

Ken Ofori-Atta's family accuses OSP

Meanwhile, it was earlier reported in the media that the family of the former Finance Minister has alleged that the Office of the Special Prosecutor is pursuing an agenda against the former appointee of Nana Akufo-Addo.

They stated that they have formally petitioned both the National Central Bureau and the Commission for the Control of INTERPOL’s Files (CCF) to have the Red Notice immediately removed.

Additionally, the family claimed that the warrant issued for Ofori-Atta on February 11 was obtained under unusual circumstances, lacking a supporting affidavit.

FBI okays Ofori-Atta's arrest warrant

Earlier, YEN.com.gh reported that the United States Department of Justice and the FBI backed Ghana's investigation into former Finance Minister Ken Ofori-Atta.

Sources at the US Embassy in Accra reportedly confirmed that the probe was legitimate and not politically motivated.

The development led to deeper scrutiny and potential accountability over Ofori-Atta's handling of the economy.
